M&S Intellectual Property & Licensing Information
The following information should clarify any questions you may have on our patents, trademarks and copyrighted technologies. Customer rights relative to this intellectual property are also summarized below.
- M&S Technologies, Inc. and its founder, Joe Marino, launched the Smart System™ Fixation system to the ophthalmology market in 1991.
- By the late 1990’s, M&S’s customer base encouraged
M&S to expand its product line to include Computerized Vision Testing
Systems. Joe Marino assessed market needs by sitting through hundreds
of examinations in clinical sites throughout the country.
- Based on the data and information collected, the concept and design
for the Smart System TM Computerized Vision Testing System was originally
conceived by M&S. The software portion of the Smart System™
was written by Nordstrom Consulting Inc., a contract software
coder.
- The Smart System™ II PC Plus was first introduced by M&S to Eye Care Professionals in March of 2001.
- From March 2001 through mid-December 2005, M&S sold and licensed
the contract-coded software in its Smart System TM Computerized Vision
Testing Systems to its end customers in the eye care profession.
- In mid-December 2005, M&S ceased use of all the contract-coded software
and launched its, new state-of-the-art system containing M&S-owned
software.
- In the spring of 2008, Dr. Jack Holladay M.D. was awarded US
Patent Number 7,354,155 for the Holladay Automated Contrast Sensitivity
System TM. This Patent is solely owned by M&S.
End User Licensing Rights
- All Smart System computerized vision testing systems sold by M&S included a software license between M&S and each individual end user. If you have misplaced your M&S end user license agreement from your Smart System TM Operating Manual, additional copies can be obtained by calling 1-877-225-6101.
- If you require technical support on an existing system purchased from M&S, please call 1-877-225-6101. Many issues can be resolved over the phone. If hardware is needed, we stock replacements and can ship overnight. If software must be replaced, you will receive the most recent M&S copyrighted software.
NOTE: Customers CAN choose who will service their Smart System support needs. M&S CAN service your needs for replacement equipment or software, whether you purchased the NCI contract-coded software or our State-of-the-Art software. M&S DOES NOT provide the NCI/Innova software on any service request.
